1. Acceptance
These terms and conditions are the terms on which StarJump offers you access to the Services and the Website. By registering as a member of StarJump you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Services.
2. Terminology
In these terms and conditions, the following expressions have the meanings set out:
'member' means a registered member of StarJump;
'Services' means any one or more of the services offered by StarJump;
'we', 'us' and 'our' are a reference to StarJump;
'you' and 'your' are a reference to you;
'Website' means any StarJump website through which the services are offered.
3. Provision of services
- StarJump is constantly innovating in order to provide the best possible experience for its members. You acknowledge and agree that the form and nature of the Services which StarJump provides may change from time to time without prior notice to you.
- As part of this continuing innovation, you acknowledge and agree that StarJump may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to members generally at StarJump's sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform StarJump when you stop using the Services.
4. Disclaimer
You expressly understand and agree that:
- Your use of the services is at your sole risk. The Website and Services are provided on an "as is" and "as available" basis;
- StarJump does not warrant that i) the services provided will be uninterrupted, timely, secure, or error free, or ii) that any information provided on the Website is error-free or reliable;
- No advice or information that is obtained by you from StarJump or anyone else shall create any warranty by StarJump that is not expressly stated in the terms and conditions; and
- Responsibility for the content of advertisements appearing on this Website (including hyperlinks to advertisers' own websites) rests solely with the advertisers. The placement of such advertisements on the Website does not constitute StarJump's recommendation or endorsement of the advertised product or service. Each advertiser is solely responsible for any representation made in connection with its advertisement.
5. Use of the services by you
- You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by StarJump, unless you have been specifically allowed to do so in a separate agreement with StarJump. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers).
- You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
- Unless you have been specifically permitted to do so in a separate agreement with StarJump, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.
- You agree that you are solely responsible for (and that StarJump has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which StarJump may suffer) of any such breach.
6. Your passwords and account security
- You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services.
- Accordingly, you agree that you will be solely responsible to StarJump for all activities that occur under your account.
7. System Integrity
StarJump will use its reasonable endeavours to ensure the availability of the Website and Services, subject to any downtime required for maintenance. However, StarJump takes no responsibility for any system unavailability, or for any loss that is incurred as a result of Website or Services being unavailable. Further, StarJump assumes no responsibility for the corruption of any data or information held by StarJump.
8. Force Majeure
Without prejudice to clause 5(a), StarJump has no liability for any lack of performance, unavailability or failure of the Services or the Website, or for any failure of StarJump to comply with these terms and conditions where the same arises from any cause reasonably beyond the control of StarJump.
9. No Waiver
If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.
10. Partial Invalidity
If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect.
11. Jurisdiction
Your access to, and use of, the Services and the Website is governed by and construed in accordance with the law of New Zealand, and you agree to submit to the exclusive jurisdiction of the courts in New Zealand.
12. Privacy and your personal information
- For information about StarJump's data protection practices, please read StarJump's privacy policy. This policy explains how StarJump treats your personal information, and protects your privacy, when you use the Services.
- You agree to the use of your data in accordance with StarJump's privacy policy.
13. Emails
StarJump will send you emails relating to your membership and other activities on the Website, and for promoting and marketing other StarJump products and services to you.
14. Entire agreement
These terms and conditions supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire agreement, between the parties, relating to the subject matter of these terms and conditions.
15. Changes to these terms and conditions
These terms and conditions may be amended by StarJump from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Services represents your agreement to be bound by the terms and conditions as amended.
